1. Introduction

Welcome to libertyofconscience.com (the "Website"). This Website is a personal project maintained by Michael Presecan ("I," "me," or "my"). I am committed to protecting your privacy. This Privacy Policy explains how I collect, use, disclose, and safeguard your information when you visit my Website.

As I am based in the European Union, this policy is also designed to comply with the General Data Protection Regulation (GDPR).

2. What Personal Data We Collect and Why

"Personal Data" means any information that can identify you as an individual.

  • Information You Provide Voluntarily:
    • Petition Signatures: When you sign a petition on this Website, I collect information such as your name, email address, and potentially your country or other relevant details you provide. The purpose of collecting this data is to gather support for the petition and to present the signatures (or a summary thereof) to the SDA General Conference in 2025.
    • Newsletter Subscriptions: If you subscribe to my newsletter, I collect your email address and potentially your name. This is used to send you updates, articles, and other information related to the content of this Website.
    • Contact: If you contact me via the provided email address (info@libertyofconscience.com), I will collect your name, email address, and any information you provide in your message to respond to your inquiry.
  • Information Collected Automatically:
    • Log Files: Like most websites, my server (hosted by Railway.app) may automatically log information your browser sends. This can include your IP address, browser type and version, operating system, referring URLs, pages visited, and the dates/times of your visit. This information is used for technical administration of the Website, to ensure its security, and to understand how visitors use the site.
    • Cookies and Similar Technologies (PostHog Analytics): I use cookies for analytics.
      • I use PostHog to understand how visitors interact with the Website. This helps me improve the content and user experience. PostHog collects data such as pages visited, time spent on site, and links clicked. My PostHog server is located within the EU.
      • Please see our [Link to your Cookie Policy page] for detailed information about the cookies we use.

3. Legal Basis for Processing Your Data (GDPR)

I process your personal data based on the following legal grounds:

  • Consent:
    • For collecting your signature on petitions and using it for the stated purpose of presentation.
    • For sending you newsletters if you have subscribed.
    • For placing non-essential cookies (like those used by PostHog for analytics) on your device.
    • You can withdraw your consent at any time (e.g., by unsubscribing from the newsletter, or contacting me for petition data, subject to limitations regarding the petition's purpose once submitted).
  • Legitimate Interests:
    • For processing server log data for security and technical operation of the Website.
    • For responding to your direct inquiries if you contact me.
  • Necessary for the Functioning of the Site: For any strictly essential cookies that enable core site functionalities (though primary visitor-facing cookies here are analytics-based, covered by consent).

4. How We Use Your Data

I use the information collected to:

  • Operate and maintain the Website.
  • Collect and manage signatures for petitions.
  • Present petition signatures/summaries to the SDA General Conference 2025.
  • Send you newsletters and other communications if you have subscribed.
  • Improve the content and user experience of the Website (via PostHog analytics).
  • Respond to your comments or inquiries.
  • Ensure the security of the Website and prevent abuse.

5. Data Sharing and Third Parties

I do not sell your personal data. I may share your data with the following third parties only in the ways described in this Privacy Policy:

  • SDA General Conference 2025: Information from petition signatures (such as names, a total count, and potentially anonymized comments or geographical distribution, as appropriate and made clear at the point of signing) will be compiled and presented to the SDA General Conference 2025 to demonstrate support for the petition's cause.
  • PostHog: For website analytics. As my PostHog server is in the EU, data processed by PostHog for analytics remains within the EU under my direct configuration.
  • Hosting Provider (Railway.app): My website is hosted by Railway.app. They act as a data processor and may have access to server logs or data stored on their platform as part of providing their hosting services. Their privacy policy can be found on their website.
  • Legal Requirements: I may disclose your information if required to do so by law or in response to valid requests by public authorities.

6. Data Retention

I will retain your personal data only for as long as necessary for the purposes set out in this Privacy Policy.

  • Petition Signatures: Data collected for petitions will be retained until the petition is presented to the SDA General Conference 2025, and for a short period thereafter for record-keeping or follow-up if necessary. After this, the personal data associated with the signatures will be deleted or fully anonymized.
  • Newsletter Subscriptions: Your information will be retained for as long as you remain subscribed to the newsletter. You can unsubscribe at any time, and your data will then be removed from the active mailing list.
  • Log files: Typically retained for a short period (e.g., 30-90 days) for security and troubleshooting.
  • Analytics data (PostHog): Retained according to my configuration with PostHog, aiming for the shortest necessary period and using anonymized or pseudonymized data where possible.

7. Your Data Protection Rights (GDPR)

As an individual whose data may be processed, you have the following rights under GDPR:

  • The right to access: You can request copies of your personal data.
  • The right to rectification: You can request that I correct any information you believe is inaccurate or complete information you believe is incomplete.
  • The right to erasure (right to be forgotten): You can request that I erase your personal data, under certain conditions.
  • The right to restrict processing: You can request that I restrict the processing of your personal data, under certain conditions.
  • The right to object to processing: You can object to my processing of your personal data, under certain conditions.
  • The right to data portability: You can request that I transfer the data that I have collected to another organization, or directly to you, under certain conditions.
  • The right to withdraw consent: If processing is based on consent you can withdraw your consent at any time. Withdrawing consent for a petition signature before its presentation may mean your signature cannot be included.

To exercise any of these rights, please contact me at info@libertyofconscience.com.

You also have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your habitual residence, place of work, or place of the alleged infringement if you consider that the processing of personal data relating to you infringes GDPR. (In Croatia, this is AZOP - Agencija za zaštitu osobnih podataka).

8. Data Security

I take reasonable technical and organizational measures to protect your personal data from loss, misuse, unauthorized access, disclosure, alteration, and destruction. However, no internet transmission is ever completely secure or error-free.

9. International Data Transfers

  • PostHog: My PostHog analytics server is located within the EU, so data processed by it remains within the EU.
  • Hosting Provider (Railway.app): My hosting provider, Railway.app, may utilize data centers located in the United States. If personal data is transferred outside the European Economic Area (EEA) through my hosting provider, I rely on appropriate safeguards, such as Standard Contractual Clauses (SCCs) adopted by the European Commission, or other lawful data transfer mechanisms that Railway.app provides to ensure your data is adequately protected.

10. Children's Privacy

This Website is not intended for individuals under the age of 16. I do not knowingly collect personal data from children. If you believe a child has provided me with personal data, please contact me, and I will take steps to delete such information.

11. Changes to This Privacy Policy

I may update this Privacy Policy from time to time. The "Last Updated" date at the top of this policy will indicate when revisions were made. I encourage you to review this Privacy Policy periodically.
